Welcome to SMMAI ("we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website, platform, tools, and related services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

By accessing or using SMMAI, you confirm that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using SMMAI on behalf of an organization, you represent that you have authority to bind that organization.

SMMAI provides AI-powered tools to help users plan, schedule, generate, and optimize social media content across various platforms. This includes integrations with third-party APIs (e.g., Facebook, Instagram, LinkedIn, TikTok).

To access certain features, you must register for an account. You agree to:

• Provide accurate and complete information;
• Maintain the confidentiality of your login credentials;
• Be responsible for all activity under your account.

We reserve the right to suspend or terminate accounts that violate these Terms.

You agree not to:

• Use the Services for any unlawful or harmful purpose;
• Interfere with the functionality of the platform;
• Reverse engineer or attempt to extract source code;
• Upload any content you do not have the right to use.

You retain ownership of any content you upload to SMMAI. By using our Services, you grant us a non-exclusive, worldwide, royalty-free license to use, host, store, and display your content solely to operate and improve the Services.

All intellectual property related to SMMAI (excluding user content) is owned by us or our licensors. You may not use our branding without written permission.

Our platform may integrate with third-party services. Your use of those services is governed by their respective terms, and we are not responsible for their content, data handling, or practices.

Some Services may require payment. All fees are clearly disclosed, and you agree to pay all charges incurred through your account in accordance with the pricing and payment terms in effect at the time.

You may cancel your account at any time. We reserve the right to suspend or terminate your access to the Services with or without notice if you violate these Terms or if we discontinue the Services.

The Services are provided "as is" and "as available." We do not warrant uninterrupted or error-free access and disclaim all warranties to the extent permitted by law.

To the fullest extent permitted by law, SMMAI is not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.

You agree to indemnify and hold harmless SMMAI and its affiliates from any claims, damages, losses, or liabilities arising from your use of the Services or violation of these Terms.

We may update these Terms from time to time. We will notify you of material changes. Continued use after changes are effective constitutes acceptance of the new Terms.

These Terms are governed by the laws of Manitoba, without regard to its conflict of law provisions. Any legal disputes must be brought in the courts located in Manitoba.
